Amgen Claims Win in Patent Lawsuit

THOUSAND OAKS, Calif. (AP) -- Biotechnology company Amgen Inc. said Tuesday a jury found that Roche's Mircera infringes on 11 of the company's patent claims.

The jury decision comes from federal court in Boston. The drugs in question are part of a class of treatments called erythropoiesis stimulating agents. They are aimed at treating anemia associated with kidney disease and chemotherapy treatment. Amgen's products in the class include Aranesp and Epogen.

In a statement, Roche said it is considering its legal options, including an appeal. The company maintains that Amgen's patent assertions are invalid.

"We believe it is important for there to be competition and choice in this country," said George Abercrombie, president and chief executive of Hoffmann-La Roche Inc. "Amgen has had an extended monopoly for the last 20 years not allowing for new therapeutic options to treat anemia to be introduced to patients in this country."

Mircera is under Food and Drug Administration review and Roche said it expects a decision Nov. 14. Amgen said it will seek an injunction to stop Roche from selling Mircera in the U.S. That hearing is scheduled for Nov. 15.

Shares of Amgen rose $1.08 to $57.20 in afternoon trading.
